Terms of Service

Agreement to Terms

By accessing or using the Trisvio platform (“Platform”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of these terms, you may not access or use our Platform.

These Terms apply to all users who access or use our Platform. By using the Platform, you represent that you are at least 18 years of age or are authorized by your hospital or organization to use the service.

Platform Usage and Account Terms

When using our Platform, you agree to:

• Provide accurate and complete registration information
• Maintain the security of your account and password
• Accept responsibility for all activities that occur under your account
• Not share your account credentials with third parties
• Notify us immediately of any unauthorized access
• Ensure patient and guardian data is collected and processed lawfully

Your use of the Platform must comply with all applicable laws and regulations. Hospitals and organizations are responsible for ensuring data processing activities comply with relevant healthcare and privacy laws (e.g., India's Digital Personal Data Protection (DPDP) Act, 2023 where applicable). The hospital remains the data fiduciary/controller for patient data; Trisvio acts as a data processor under the hospital's direction.

Subscription and Payments

We offer various subscription plans with different features and usage limits. By selecting a paid plan, you agree to:

• Pay all applicable fees as they become due
• Provide valid payment information
• Accept responsibility for all charges incurred
• Keep your billing information current

Fees are non-refundable except as required by law or explicitly stated in our refund policy. We reserve the right to change our pricing with advance notice.

Intellectual Property Rights

The Platform and its original content (excluding content provided by users), features, and functionality are owned by Trisvio and are protected by applicable copyright, trademark, and other intellectual property laws.

While using our Platform, you retain ownership of your content and data. You grant us a license to host, transfer, and process your data as necessary to provide our services.

Platform Rules and Restrictions

You agree not to:

• Use the Platform for any illegal purposes
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt our servers or networks
• Reverse engineer or attempt to extract our source code
• Upload malicious code or content
• Exceed your plan's usage limits intentionally
• Resell or redistribute our services without authorization

We reserve the right to suspend or terminate accounts that violate these rules.

Data Processing and Security

We implement reasonable security measures to protect your data. However, no system is completely secure, and we cannot guarantee absolute security.

When using our Platform:

• You remain responsible for your data's accuracy and legality
• You must obtain necessary consents for data processing and patient/guardian data where required
• You should maintain appropriate backup procedures
• You must comply with our security guidelines

Patient data is sensitive personal data. The hospital acts as data fiduciary/controller for patient data, and Trisvio processes it under the hospital's direction and in accordance with our Privacy Policy and applicable data protection laws.

Service Level Agreement

These Terms do not include an availability commitment or service credits. We do not guarantee uninterrupted service, and we may perform maintenance with advance notice.

Limitation of Liability

To the maximum extent permitted by law, Trisvio shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

• Your use or inability to use the Platform
• Any unauthorized access to your data
• Statements or conduct of any third party
• Service interruptions or data loss

Our liability is limited to the amount you paid for the service in the past 12 months.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or Platform notification. Continued use of the Platform after changes constitute acceptance of the modified Terms.

Governing law: India. These Terms are governed by the laws of India, and any disputes will be subject to the exclusive jurisdiction of the courts at the location of Trisvio's registered office (to be confirmed at launch).
